Debt Collection Agency: A Boon To Lenders

Debt collection agency is an agency appointed by a company or any creditor to collect payments that are due to them. These companies, whose main business is to lend money as personal loans, House loans or Auto loans, need to collect their monthly installments regularly to keep their business running. If they concentrate on collections then they will not be in a position to concentrate on their main business. So the business process outsourcing of collection activities of all payments that are outstanding are given to the debt collection agency.

In many of the places, a registered license is not required to start a debt collection agency. However some states demand a registered license for these companies. These agencies can be a separate concern or a division of the lending company. These agencies take a part of the collection amount as their charge towards their service. Sometimes these agencies buy the whole debt and hence they take the whole amount collected. In any case, they cannot take away the property of a debtor to compensate the loan, without winning a case before the court of law.

A debt collection agency in general, should have experienced professionals in the field of debt collection. They should have good legal knowledge and should know what can be done and what should not be done while collecting the dues from the debtor.

The collection agency has to keep updated records on all those who owe money to the agency that has given the loans. This list will include customers from whom regular installments have to be collected, defaulters, and for those whose earlier checks have bounced from their banks for the reason of insufficient funds. Each of these individuals has to be handled differently.

The agency should be well equipped with the required manpower to follow up with the collection work. The debt collection agency is strictly prohibited from doing the following things. They should not call the debtor at early hours or late hours of the day.

They should not harass the person, physically or mentally to collect outstanding dues from them. Even frequently making calls to the customer and annoying him is considered as harassment. Threatening the customer that he will be arrested, physically attacking a person, spoiling his reputation in his workplace and damaging his goodwill among friends and relatives are also considered harassment. If the debtor files a suit against the debt collection agency, the agency may even lose their license and might have to pay compensation to the customer.

The debt collection agency can also file a suit against the debtor who actually owes a debt to the creditor, but is actually trying to cheat or default. If they win the case, the property of the debtor can be acquired by the agency and the money can be recovered. These agencies should maintain a tactful balance, collect the dues and follow professional ethics while doing so.
